The accused came with little Tim’s parents to the trial in the Steyr District Court. You can see it’s a tough walk for him. Lawyer Ewald Wirleitner: “The whole thing takes the family with it.” The grandfather was with the two-year-old in the family garden in Garsten on December 30, 2021, taking his eyes off him for just a few seconds.
The clever little boy took advantage of this moment, presumably climbing a Grander and falling over the protection into a fishpond. He died a few days later of cardiac arrest due to the cold shock.
‘Residual risk always remains with children’
Lawyer Wirleitner: “The issue of the duty of supervision should not be exaggerated. There is always a residual risk in children. Everywhere was carefully cordoned off. But the little one was really smart.” Judge Stefan Aicher is very careful with the 74-year-old, not only about whether he is guilty or innocent, but also how the suspect is coping with the psychological stress following the death of his grandson. “I don’t know if I’ll ever get over this incident,” the retiree says with tears in her eyes.
Diversion with fine
This clears the way for diversion with a fine of 500 euros. And the memories of the little one break from the senior: “I would give my life for his. He always picked me up for dinner. He was with me for a few hours every day. I miss him so much, I’ll tell you.”
