A Romanian (26) is serving a several-month prison sentence in Graz-Jakomini prison for theft. According to the prosecutor, he tried to stab his fellow inmate with two pieces of glass; the man barely survived. He was tried on Wednesday: six years and six months in prison for intentionally causing grievous bodily harm, not legally binding.
People with big problems meet in a prison. There are often several detainees in one cell and the waves are often high. This was also the case in Graz-Jakomini prison in January 2023. Two prisoners were joking and throwing water at each other.
“I wanted to hit him”
However, a third resident (26) who was lying in bed did not find it so funny. When, according to his statement to chairman Michaela Lapanje, he was also given an entire cup full, his hat string broke. “I stood up and told him I was going to pour a bottle of water over his head.” If he did, he tore off his head, the opponent would have replied. “I wanted to hit him, but thought it would be better to call the prison guards on the intercom. I did that twice, but no one came.”
Fearing the other two, who were physically superior to him, he broke both mirrors in the cell and took two sharp shards about 10 inches long. “I wanted them to stop. When one of them kicked me, I cut him. Three times.” He only wanted to defend himself, not kill the other person.
The victim barely survived
However, public prosecutor Johannes Winklhofer considers the attempted murder as fulfilled. The victim (29), a fellow countryman of the suspect, suffered stab wounds to the neck, upper body and upper abdomen. The main artery in the neck was narrowly missed. The prisoner only survived because he took refuge on a bunk bed and the third person involved tried to stop the bleeding with a sheet.
The suspect blames the bailiff
“Don’t you think he only kicked you because he was afraid of you and wanted to keep you at a distance?” After all, they had two weapons in their hands.” The victim is also said to have held the mattress up to protect himself from further stab wounds. “That is the only reason that there were no further injuries,” the public prosecutor is convinced. The defendant disputes this and criticizes the bailiff: “They did nothing, while they could have prevented everything!”, he is angry. Now jury member Andreas Rom is speaking out: “What nonsense! There are only three prison guards responsible for 100 prisoners. They can’t be there all the time!” Prosecutor Winklhofer agrees: “I have never heard of such a thing, that the bailiff is blamed when perpetrators stab! If only you hadn’t stabbed me!’
By the way: the victim and the second prisoner preferred to stay away from the court.
