The widow – she is chairman of the Graz Regional Criminal Court – of the late former chief of the legal department Christian Pilnacek is suing the man who secretly recorded a conversation with critical content about the ÖVP.
According to her lawyer, Caroline List-Pilnacek wants to protect her husband’s post-mortem personal rights and is now suing to have the recording deleted, the news magazine ‘profil’ reported on Saturday.
In the recording, Pilnacek, who was suspended at the time, accused several ÖVP politicians, including National Council President Wolfgang Sobotka, of intervening in noisy lawsuits.
Pilnacek emphasized in the conversation that he never gave in to these interventions. Those involved deny the accusations.
Investigation into misuse of listening equipment
The Public Prosecution Service is probably investigating the entrepreneur who made the recording due to Article 120 of the Criminal Code (“Misuse of eavesdropping equipment”).
Found dead near Krems
Pilnacek was found dead near Krems on the night of October 20 after a police check during which his driver’s license was confiscated. He had been suspended since 2021 due to initial suspicions of betraying state secrets. The Federal Disciplinary Commission initially lifted the suspension, but it was reaffirmed in subsequent higher instances.
