Dog box case – victim advocate announces lawsuit against the state of Lower Austria

In the case of a now 13-year-old who was allegedly locked in a doghouse and tortured by his mother in the Waldviertel (Lower Austria), victim advocate Timo Ruisinger wants to file an official liability lawsuit against the state of Lower Austria.

The mother and a suspected accomplice were not legally sentenced to prison in Krems at the end of February and were sent to a forensic therapeutic center. The lawyer suspects a failure by the authorities, ORF NÖ reported on Friday.

Internal processes re-checked
In the criminal proceedings, there was evidence “that allows us to conclude that the officials and employees of the district administration of Waidhofen an der Thaya did not do everything possible to prevent harm to the child,” Ruisinger said. After the case became public last year, the Child and Youth Welfare Office emphasized that a direct examination of its internal processes showed that “all legal and technical requirements were met.” Due to details revealed during the legal proceedings, the case was re-examined. The state technical supervisory authority should investigate “whether all legal and professional standards” have been met.

Own son abused
The 33-year-old mother allegedly beat her son, tied him up, gagged him and repeatedly locked him in a dog crate for hours. On November 22, 2022, the child was in an acute, life-threatening condition. The twelve-year-old survived thanks to the intervention of a social worker who was known to the family through guidance. A former friend of the Waldviertler woman is said to have been an accomplice to the child’s mother.

20 years in prison
The 33-year-old was sentenced to twenty years in prison in the jury trial for attempted murder, torturing or neglecting minors, young or defenseless people and for deprivation of liberty. Her former friend was sentenced to 14 years for persistent violence as an accomplice or intended perpetrator. In both cases, they were also ordered to be placed in a forensic therapeutic center. Both verdicts are not yet final because defense lawyers have filed an appeal.
