After a multi-million dispute over the inheritance in Pasching, a well-known psychiatrist from Upper Austria was taken into custody. A Viennese celebrity lawyer is now defending him and immediately brings out the big guns against the Wels public prosecutor’s office.
This involves a maximum of 50 million euros and the investigation into serious fraud against a lawyer and a notary. And it is about a well-known psychiatrist who was even held in custody for several days. Viennese famous lawyer Nikolaus Rast has now taken over his defense. “I am stunned by what happened,” he said in an interview with the “Krone”.
He could not understand why his client was taken into custody in the first place. “That was actually an arrest. Apparently they wanted some information from my client,” Rast told the Wels public prosecutor’s office – and then followed up: “Fortunately, the WKStA has taken over the case. Because they immediately took the man out of custody.”
Only reports are drawn up
Why the 72-year-old psychiatrist became involved in the case is still a mystery to Nikolaus Rast. “He prepared a report and received normal compensation for it. Why would he do this as a favor? What would he get out of it?” asks the Viennese lawyer. The expert prepares approximately 150 reports per year. “A person like that wouldn’t risk his entire successful career just to please someone.”
“Family disputes over money are not a crime”
For Rast the whole matter is questionable. “There won’t be much left in the field of criminal justice. I’m sure you won’t even be charged. “In principle it is simple: a family fights over money and that is not a crime,” he says.
It concerns many millions of euros
And that’s what it’s about: for seven years there was a family dispute over an agricultural land in Pasching, involving all legal and other resources. In 2022, the owner suddenly transferred the property to her cousin.
A lawyer – she has temporarily resigned from her practice – presented two private reports in an adult protection case that demonstrated the woman’s legal capacity. The contracts were therefore valid. But another branch of the family fought against this. Now the WKStA is investigating whether the story is a scam or not.
