There were a total of four guilty verdicts in an IS trial at the Linz Regional Court on Thursday. A legal expert explains how the supposedly mild sentences for the young suspects – aged 16 to 19 – came about and why the 19-year-old was released with her baby.
How do you ensure that suspects no longer commit crimes? A jury in Linz had to answer this question on Thursday in an IS trial against four suspects (16 to 19 years old). In the online comments on krone.at, people were surprised at the supposedly mild punishments. Walter Eichinger, spokesman for the Linz Regional Court, explained how the different sentences were arrived at.
Impeccable and well-known
The two young suspects (16 and 17 years old) each received a six-month suspended prison sentence. “The mitigating factors were her integrity and her at least partial confession,” Eichinger said. The duo’s sentence was a maximum of five years, meaning they received approximately one-tenth of the maximum.
The 19-year-old has also been flawless so far. Unlike the other two, he must pay part of his fine: a total of 2,400 euros. In addition to his 13-month suspended prison sentence, he was also given probation.
“Feeling Nausea”
His wife, who had already been convicted under Islamic law, received the maximum sentence of 24 months. She had been in pre-trial detention for eight months since October 5 and was allowed to go home with her baby after the verdict. “She has now felt the setback of detention and that does something to people,” Eichinger explains.
Deradicalization program
All four convicts must also participate in a deradicalization program of the association “Derad”. Reports are also regularly sent to the court from there. If the four do not participate, the penalties imposed could still be ‘severe’. The statements are not legally binding.
