Heavy storms, floods and mudslides have also caused damage to numerous vehicles in many places in recent days. Whether the insurance pays depends on the type of vehicle, the insurance contract and the person who caused the damage.
“If you have only taken out liability insurance, you will not receive any money from the insurer in the event of storm damage. Damage to motor vehicles caused by natural forces is usually only covered by fully or partially comprehensive insurance,” explains ÖAMTC chief lawyer Martin Hoffer. Damage to bicycles and e-bikes is usually covered by home contents insurance. In all cases: document vehicle damage as best as possible and report it immediately to the relevant insurance company.
However, if the damage was caused by a third party, they are primarily liable if they are at fault. For example, if construction companies or advertising companies have placed their scaffolding and billboards incorrectly. Even if loose roof tiles or trees fall on a parked car, the owner of the home can be held liable.
“If the vehicle is damaged by loose objects on the road, the road authority (state or municipality) is liable if it can be proven that he has been grossly negligent – for example by carrying out maintenance. B. gross negligence in securing a flood point. Highway managers and rental companies of paid parking spaces are already liable for minor negligence,” says Hoffer. Since May 1, 2024, damage caused by trees has been difficult for the injured party to a certain extent: guilt must now also be proven before the burden of proof is reversed;
Check your full and partial insurance policies and report any damage immediately
With full and partial comprehensive insurance, the insurance covers repair costs and also the costs of towing to the nearest suitable workshop. Depending on the insurer and contractual provisions, deductibles are also possible. The correct procedure is important to cover the costs: “The damage must be reported immediately. Documentation with photos, especially with all the details of the damage, is an advantage,” said the lawyer. If someone else is responsible for the damage, it is advisable to name witnesses.
However, insurance also has its limits: if the car is parked in a vulnerable place, for example under a clearly rotten tree, the insurance company can refuse to pay out due to gross negligence. However, if you were surprised by the storm or if you were unable to the best of your knowledge and belief to move the vehicle out of the danger zone, the situation is different.
If there is a total loss, this is particularly annoying for older vehicles, because the maximum amount that is usually replaced is the current value.
