A 16-year-old died of an overdose in his apartment in Vienna-Wieden after he abused her while she was defenseless. Yet the 55-year-old Romanian says: “I can only laugh at the accusation here. She agreed with everything we did.” From the start of the trial it becomes clear that the man is not a clean slate: he is a convicted murderer.
“nichtraunzer” is written in large orange letters on the defendant’s T-shirt as he enters trial room 1 of the Vienna Regional Court. But that does not apply to the 55-year-old, because he gives the judge sloppy answers and does not want to answer some questions at all. One of his emotional outbursts: “It’s something that has embarrassed me for seven months. And I have to experience it all again here.”

The Romanian is referring to the night of December 9 to 10, 2023 – when he used drugs together with a 16-year-old in his apartment in Vienna-Wieden and allegedly abused her while she was completely disabled. “He sees her lying motionless on her stomach,” the prosecutor explains. Then the man, who was almost forty years older than her, performed sexual acts on her. The suspect only realized on Sunday morning that the girl had died of an overdose.
The Public Prosecution Service files charges for sexual abuse of a defenseless person. According to investigations, the 55-year-old is not responsible for the 16-year-old’s drug-related death. But the Romanian also pleaded not guilty in his abuse trial: “I can only laugh at the accusation. She agreed with everything we did. She wasn’t super disabled,” he begins his long and uncooperative statement.
The suspect was concerned about the victims
He tells how he first met the victim at the Westbahnhof and saw her buying drugs: “She was very clean. So she wasn’t part of the scene. I mean nice and fresh, not like the others. “I didn’t agree with her taking so many drugs at such a young age.” In the days before the crime, he often took her to his apartment. Because “that’s part of it,” he explains to the chairman.
The 55-year-old does not really want to talk about the sexual acts that ultimately took place in early December on the night from Saturday to Sunday. He simply expressed his outrage in a loud voice: “I have never raped anyone in my life. Especially not four times. That is not biologically possible.” Then he continues to grumble: “I am helpless myself and I try to do the best.”
Already convicted of murder
Of course, this trial is not the first time he has appeared in court. In Austria alone, the Romanian has seven previous convictions: negligent homicide, bodily harm and property crimes. And the man has already been convicted in Germany and spent twelve years in prison. Namely for simple murder. He doesn’t want to say more about it…
Witnesses and experts speak throughout the day in the abuse process. The toxicological expert in particular will be crucial. A ruling is expected by the end of the afternoon. There is a risk of up to ten years in prison.
