A player who lost 30,000 euros in just two months in an illegal online casino is trying to hold the Republic of Austria responsible. The company is now bankrupt. The man sees no way to get his money back there.
According to the file, Julia Eckert, the plaintiff’s lawyer, argues that the Republic of Austria was aware of the illegal activities but did nothing about it. Therefore, the Republic must compensate the damage caused.
In the first two cases the lawsuit failed
The first judge saw no connection between the alleged violation of the law and the damage suffered by the player. Secondly, it was argued that the gambling monopoly would serve to protect the financial interests of individual players, but this was only aimed at the gambling providers and not against the state. Nevertheless, Eckert filed the proceedings with the Supreme Court in April 2024.
