On Wednesday, a 41-year-old man had to appear in court in Feldkirch (Vorarlberg) because he caused a serious accident while drunk in March. The tragic consequences of the crash: The victim still needs care.

The devastating collision took place in the early evening of March 9 on the L 190 in Nenzing. After attending a football match and a birthday party, the 41-year-old construction worker with 1.6 per mille alcohol in his blood gets into his car and drives towards Bludenz. Near the Liebherr company, he loses control of his car on a bend and drives into oncoming traffic. The 28-year-old driver of the oncoming vehicle tries to avoid a collision. But the sober young man doesn’t stand a chance.
The violent impact threw the 28-year-old’s vehicle onto an adjacent embankment. While the drunken man who caused the accident escaped with minor injuries, the young Nenzinger was trapped in the vehicle and eventually had to be cut out of the completely destroyed car by the fire department.
Suffered a traumatic brain injury
The seriously injured man is flown to hospital by rescue helicopter, where doctors fight for his life. Due to numerous broken bones, vertebral fractures, a ruptured liver and spleen, as well as traumatic brain injury and cerebral edema, the victim had to be kept in an artificial deep sleep for two months. The 28-year-old has been in a vegetative state since May. What is especially devastating for his relatives is that the young man will need care forever!
That is why victim representative Sascha Lumper is demanding partial damages of 15,000 euros in the trial on Wednesday. Especially because the suspect pleaded guilty to bodily harm through negligence at the beginning of the trial.
Traffic expert Christian Wolf concludes in his report that the victim had no chance and was simply in the wrong place at the wrong time. According to the expert, the 41-year-old drunk driver was driving at a speed of between 80 and 95 km/h against oncoming traffic. “Only 60 km/h is allowed on the route. This means that the two vehicles could have passed the scene of the accident smoothly. The suspect should have simply stayed in his lane,” Wolf concludes his remarks.
Judgement not yet final
Judge Alexander Wehinger finds the person who caused the accident guilty and imposes a partial prison sentence of twelve months, eight of which are conditional. The Council awarded the victim 15,000 euros as partial compensation. The convicted person must pay this within 14 days. The verdict is not yet legally binding.
