This Thursday, the European Commission (EC) opened a case against Spain and 16 other European Union (EU) countries for failing to correctly apply the Community’s performance and pricing plan for air navigation services.

The Community Executive explained in a statement that these states are not correctly applying “certain provisions of the Single European Sky performance and pricing plan for air navigation services”.
The Single European Sky Regulations oblige Member States to share common costs between en route and terminal air navigation services on a proportionate basis, based on a transparent methodology.
In addition, they must include this in their performance plans incentive systems to support the achievement of objectives.
According to Brussels, the problems identified in the 17 countries “relate to the inadequate level or allocation of costs charged to airlines, as well as to insufficient financial incentives for service providers.”
Incorrect implementation of EU rules not only affects the revenues of air navigation service providers, but also the level of fees paid by airlines, as customers of these service providers.
The countries have two months to respond and correct the deficiencies identified. If there is no satisfactory response, the Commission may proceed to the next stage of the infringement procedure and issue a reasoned opinion.
