22-year-old convicted – false statement: “was locked in the trunk”

Now the 22-year-old himself is on trial for defamation and making false statements. The question of motive remains, even after the verdict is announced.

“Victims must tell the truth. Especially in the case of sexual offences, it is often a case of statement against statement. “We are dependent on the information of the victim,” the public prosecutor recalls in her closing argument in the trial of a 22-year-old.

“Grabbed from behind and locked in trunk”
In early October 2023, the young Viennese woman reported rape – and also gave a name. A 28-year-old, whom she had met shortly before, allegedly intercepted her at night: “I was grabbed from behind and locked in the trunk.” and raped her.

The 28-year-old was detained for two weeks
The investigation was launched and the suspected perpetrator was taken into custody. However, it turns out that mobile phone data, surveillance videos and victim statements do not match the story at all. But she sticks to it despite tears in the Vienna Regional Court. “He was the perpetrator, I am one hundred percent sure of that,” she shouts from the dock.

But his alibi and the path-time diagram created later also contradict this accusation. After two weeks, the 28-year-old was released. For the trial, he uses his witness appeal: “I heard about the compensation. That’s a ridiculous amount. I think 20 or 25 euros a day. Is freedom really worth so little?” The man also speculates: “There are only two options as to why she says this: she wants to hide it because it’s someone from her circle of friends or because she is already so deeply involved with the court.”

Both Judge Stefan Erdei, the prosecutor and her own lawyer give the Viennese the chance to put things right. “We have done everything we can to clarify an act that supposedly happened to you,” the prosecutor finally gives up.

One and a half years suspended prison sentence
“I have the impression that something happened to them. But I have no idea what it is. “It is absolutely not what you said to the police,” Judge Stefan Erdei sentenced the young woman to 18 months in prison for defamation and making false statements. The 22-year-old accepted the sentence despite denying responsibility.
