Suspicion of wrongful death – that is the charge against the 40-year-old mother from Oberhofen am Irrsee, who saw her 11-year-old son die in an accident two months ago.
Markus had traveled with his mother on a two-seater Puch DS50 and was also allowed to drive alone on a goods road for a while. Mother looked. And saw her son drive into an unlit tunnel – and collide with an oncoming tractor in the middle. The moped caught fire, mother pulled Markus away, but all help came too late for the boy.
Didn’t have a moped driver’s license
It took a while for the police to even question the mother, but now the final report is ready. The court was charged with culpable homicide against the 69-year-old tractor driver and also against Markus’s 40-year-old mother. Because she shouldn’t have given her eleven-year-old son the moped because he didn’t have a driver’s license yet.
“The prosecutor has several options. He can transfer the procedure to the public prosecutor, stop it or simply file a report,” explains Barbara Rumplmayr of the Wels public prosecutor’s office.
Redirection as a not-guilty option
If the proceedings are not stopped, distraction is a solution often used when the suspects are close relatives of the victims. This happens when all circumstances have been clarified and responsibility has been accepted. There is no conviction or conviction, but you pay a fine or do community service. There is also no entry in the criminal record.
