Everyone has probably said a swear word or two during an argument. However, this does not mean that the requirements of Section 115 of the Austrian Criminal Code are immediately met. Attorney Sascha Flatz explains: “Anyone who insults, mocks, abuses or threatens to abuse someone in public or in the presence of several people must be punished.” This can result in a prison sentence of up to three months.
