It was a terrible accident: at the beginning of July, during a storm on the playground in Linz, parts of a tree fell on a mother (41) and her nine-year-old daughter, seriously injuring them. Now there are the first results of the investigation: the ginkgo was completely healthy and the accident was unforeseeable.
On July 6, a wild storm raged through the center of Linz, where the knights’ festival was taking place that day. As a result, parts of a tree fell over on the playground and several people were injured. In particular, a mother (41) and her nine-year-old daughter from Kremsmünster, who remained unconscious and seriously injured – as reported in detail by the ‘Krone’.
Report on tree completed
The incident has been a source of concern to investigators for some time – and now the first results are in: the report on the previously 28-metre-high tree is ready. The ginkgo – it is privately owned on a plot of land next to the playground – was therefore healthy and in perfect condition, as Ulrike Breiteneder from the Linz public prosecutor’s office explains: “According to the report, the failure of the tree was unforeseeable. It was also regularly maintained and checked.”
Investigations continue
The Public Prosecution Service’s investigation is not yet complete. In addition to the condition and proper care of the tree, it must also be examined “whether the organizer should have taken measures,” says Breiteneder. The investigation is being conducted on suspicion of bodily harm through negligence; if convicted, there is a risk of up to six months in prison or a fine.
