Germany seizes real estate belonging to Russian citizens for the first time

The Munich public prosecutor’s office and the Bundeskartellamt (BKA) have seized three houses in the Bavarian capital owned by two Russian citizens. It is the first time since the start of the invasion of Ukraine that the German judicial authorities seize real estate in this country from citizens of the Russian Federation, applying the sanctions imposed by the West on the Moscow regime.

The Public Prosecution Service also announced the seizure of the current account into which the rent of the houses had been deposited. Those affected are a member of the State Duma, the Russian parliament, whose last name begins with ‘L’, and his wife, who is listed as a permanent resident of the Bavarian capital. The public accusation accuses both of violating sanctions imposed by the European Union. “To our knowledge, this is the first case at the national level in which not only assets (in this country) are frozen, but also real estate due to sanctions,” said senior prosecutor Anne Leiding. A monthly payment of EUR 3,500 was made into the current account for the rent of the flats that had been negotiated.

Since February 23, the Russian deputy has been on the list of people with Russian citizenship sanctioned by the EU for supporting Russian President Vladimir Putin’s regime in the invasion of Ukraine. At the time, the Duma MP voted in favor of a resolution demanding Putin recognize as independent states the self-proclaimed Donetsk and Kugansk republics claimed by pro-Russian separatists in eastern Ukraine.

The embargoed Russian deputy, as well as his wife, cannot continue to bring money into Germany. The investigation into the marriage revealed that both co-owners of two houses in Munich and she exclusively owns a third.

Prosecutor Leiding emphasized that in her case not only were the assets frozen, but their houses were also seized. Such action is possible under German criminal law, although no such case had occurred to date.

The order for the intervention of the goods and real estate was ordered by the Munich municipal court at the request of the local public prosecutor. That same Monday, the Russian marriage was deleted from the land registry, confirming the implementation of the embargo. The tenants can continue to occupy the apartments, but will pay the rent to the court hearing the case.
