OGH decision – The captain of “Pirates of the Caribbean” is back in custody

A spectacular case takes another astonishing turn. In July 2024, a 64-year-old former captain who had piloted a ship in the Hollywood blockbuster ‘Pirates of the Caribbean’ was sentenced to 30 months in prison, ten of which were suspended, for defamation in the LG Wiener Neustadt. The Lower Austrian is said to have elaborately staged his own kidnapping and murder by his ex-wife in the autumn of 2023. So the woman was actually suspected of murder.

Both the prosecutor and lawyer Michael Dohr are fighting the verdict. Because the appeal is still ongoing, but the fixed part of the sentence had already been served, the Hollywood extra was released on October 29 – against which the Public Prosecution Service filed a complaint.

The Supreme Court confirms the risk of committing crimes
And indeed: less than a week later, the handcuffs clicked again on the captain, who wanted to take care of his 95-year-old father. Dohr filed a fundamental rights complaint against the new pre-trial detention. But the Supreme Court (OGH) has now confirmed that this is justified due to the risk of committing a crime.

The lawyer is shocked: “Until now, it was customary to be released after serving the unconditional part, because it had to be assumed that there were no longer grounds for detention. The current decision is downright frightening.” The Supreme Court thus contradicts its own case law.
