“Kron”: Is it common for parents to disagree about child support payments?
Simon Kapferer: I know it’s often straight forward. You can make maintenance appointments at the BH, which works very well as far as I have noticed. In cases that end up before a lawyer, one parent usually refuses to pay. When it comes to spousal maintenance, you can make agreements yourself. For example, consider waiving alimony or agreeing on a fixed amount. When it comes to child support, that doesn’t work. Legally, the child is entitled to the money even if one parent controls it. Otherwise, you will need permission from the custody court. The court must check whether the agreement is in the best interests of the child. However, agreements are probably made outside the court. However, these are legally ineffective.
