The U.S. Supreme Court on Thursday authorized the country’s president, Joe Biden, to suppress the program “Stay in Mexico”an immigration policy from his predecessor, Donald Trump, that forces asylum seekers to wait for their case outside the United States to be resolved.

On his first day in the White House, Biden tried to end this program, but a federal judge in Texas ordered it reintroduced and the government appealed to the Supreme Court, which ruled in his favor, saying the decision did not conflict. is with the law.

The top US judicial body has not evaluated Trump’s immigration policy, officially known as the Migrant Protection Protocols (MPP), but the legality of Biden’s decision to end the program.

By five votes to four, Supreme Court justices have ruled that the memorandum issued by the government last October to end “stay in Mexico” did not violate federal immigration law

As part of his policy of zero tolerance on migration, in 2019 Trump has the MPPa policy that has been strongly criticized by human rights organisations, which affected for more than 60,000 asylum seekersmost of whom were stranded in camps on the Mexican border.

Biden attempted to revoke this policy last year but faced opposition from Texas and Missouri attorneys general, who managed to get a federal judge in the former state to order the reinstatement of MPPs.

In August, a federal appeals court and the Supreme Court rejected attempts by the government to block the Texas judge’s ruling.

In October, the Minister of National Security, Alejandro Mayorkas, published a memorandum revoking “Stay in Mexico”, but the executive had to reactivate the program after another court decision.

After negotiations with the Mexican government, the United States reactivated the program in December last year.
