Data discounts – Consumer lawyers complain against “Lidl Plus” app

In Germany, the Consumer Center of Bundeverband (VZBV) has submitted an order against the “Lidl Plus” app for the Stuttgart Higher Regional Court. Lidl does not inform users sufficiently that they have paid the app discount with their details, the association said in Berlin.

It will therefore violate consumer rights. The “Lidl Plus” app can also be used in Austria and in all “Lidl -Plus” countries.

The higher regional court confirmed the receipt of the lawsuit. Lidl did not want to comment on current legal disputes.

The digital bonus program is a thorn in the side of the proponents of the consumer. Rosemarie Rodden, the legal officer of the VZBV, explained who used the app, received exclusive app discounts. “But: these discounts are only available in exchange for personal information.” According to the advocates of the consumer, Lidl does not sufficiently provide the app before the conclusion of the user contract, nor in the corresponding Lidl-Plus usage conditions that consumers pay the app discount with their personal information.

Information light in Digi Bonus programs unclear
The association speaks of a pilot procedure – so far it has not been sufficiently clarified which information obligations exist for digital bonus programs that provide consumer data in exchange. According to the discounter, more than 100 million customers use the “Lidl Plus” app to take advantage of discounts, coupons and actions, the “food newspaper” continued.

The discount was angry in the past, for example with the advertisements for exclusive app discounts. The consumer center of the state of Baden-Württemberg accused Lidl that the regular price for customers without an app was not specified. The procedure is pending before Heilbronn court. A negotiation date is not yet known.
