Because he taught, despite Covid’s disease, a professional school teacher was released. Incorrect, as it is clear after a legal dispute in the long term. But the problems between educators and the educational institution have not become smaller …
“It was always very nice to work with the students. But it was taken to me.” Not with criticism of school management, a (still) educator of the St. Pölten State Office School. The 56-year-old has been working there since 2010. But the offset printer scholar is no longer in class.
During the Corona Pandemic, the man was released in 2022. According to management, he taught the disease of the disease and only went home after a positive test. That had caused “flagrant, lack of responsibility”. He was only released – but only two weeks later.
Immediately go out of the OGH
According to the 56-year-old voice that did not feel healthy. The result of the test surprised him then. That’s why he went against dismissal. The result was a legal dispute for years until the teacher came straight for the Supreme Court last year. Curious: the last justified his decision with the fact that the school had only responded considerably to the supposed violation. As a result, the SO -driven directness was not observed.
After the dismissal had to be withdrawn, the teacher is now exposed to a written warning due to an alleged breach of duty. He had not died sickly because of a rehabilitation after the summer holidays. “I informed the directorate and hadn’t even had a timetable. There could be no problems with the division,” he says.
The 56-year-old not only regards himself as a victim, he describes the mood within the team as extremely critical. “There is a structural problem, so several colleagues run the risk of burnout. A teacher was refused for a final hour of hours shortly before the retirement is taken, another gets too many supplier hours without questions he cannot ask,” he says a few examples.
“No complaints”
From the side of the educational directorate, the allegations with unlimited people are responding. It remains that the dismissal would have been justified and the procedure was only adopted for the teacher for “formal reasons”. Otherwise there would be no complaints from other educators. “The person involved is welcome to contact us or the staff representative at the school location to discuss assumed complaints,” says it.
But that seems difficult: the 56-year-old has only communicated since the recent warning by his lawyer with the school …
