Connecting the judgment in the conflict of a popular hiking trail in the Weiz region in Styria: the route, which has been closed for years by two landowners, must now be released for day trotters – The judiciary has now decided. Alpine clubs cheer!
The origin of the conflict goes back to January 2020. After a branch had fallen on a popular hiking trail in the municipality of Thannhausen near Weiz, two real estate owners Morning Air felt. The farmers insisted on laying the marked route to the Staatsweg, walkers directly at the houses would no longer be desired. The arguments line of the affected people was mainly based on their property rights.
Alternative variants rejected
“We really tried a friendly solution and have proposed five alternative routes,” says Jürgen Dumpelnik, State Chairman of Naturfreunde Styria. However, the conversations did not come, an agreement could not be reached. The Alpine Club “for security reasons” could not live with the variant in the street that led by the farmers in the meeting.
Ultimately, nature lovers, whose map material the route has been registered since 1971, only remained in court. A premiere: “The decision was not easy for us. Usage conflicts – such as in Weng near Admont or in the Obertyrian Lobmingtal – have increased in recent years, but usually there has always been a friendly solution,” emphasizes styric state manager Rene Stix.
District court has made a clear opinion
The greater the relief about the judgment of the Weiz court, who confirmed the legal opinion of nature lovers on all points: “It was officially acknowledged that an inheritance of the service legislation took place by more than 30 years of uninterrupted use”, the two nature lovers are satisfied.
“For us, this judgment is more than a legal success – it is a clear signal for the protection of general freedom of movement. This is a valuable possession that we will continue to defend the result,” says Dumpelnik.
Possibility to call
The other side now has four weeks to appeal. If this fails, the judgment will be final and it can also be enforced if necessary. The landowners or their legal representatives involved were not available for comment.
