The prohibition applies until the EU committee has tested and included the advertisements and included in the list delivered.
The judgment should have noticeable consequences, especially for the growing market with nutritional supplements.
In particular, it is about a procedure against the Novel Nutriology of Hamburg Company. It applied for a dietary supplement with the fact that it contains a mood reinforcement of saffron extract, as well as a melon juice extract that reduces feelings of stress and exhaustion. The Association of Social Competition saw this an unacceptable health -related explanation and complained.
Many advertisements about “Botanicals” were rejected
A list of the EU actually regulates what health -related information is permitted. For example, it determines when it is precisely the explanation that the vitamin biotine contributes to a normal function of the nervous system.
However, applications with advertising declarations on such – Called Botanicals in this list were rejected in large numbers by the responsible authority – also due to a lack of studies. As a result, the committee did the investigation into statements about “botanicals” on ice. Whether these advertisements have not yet been admitted to the list was the core of the procedure at the ECJ.
The judges denied this in their judgment. Exceptions are possible if there is a separate regulation. This is not the case in the present case, which was referred to the ECJ by the German Federal Court of Justice.
