Two drivers successfully defended themselves against imposed 50-euro punishment in Innsbruck. It turned out that the regulation of the short park zone was illegal. Numerous claims for recovery are now of course in the room.
If you park your car for too long in a short parking zone, you should expect you to get a parking ticket. This also thought that two Tyroleans, who had a “lump” on the windshield in August 2022 and February 2023 in Innsbruck because their parking ticket had expired. The city of Innsbruck each wanted to collect 50 euros – or, in the case of an impulity, the prison conditions of one day and 21 hours broke.
Administrative criminal proceedings
With the help of lawyer Karl Hepperger, however, the car drivers defend themselves successfully and now do not have to pay the punishment or view a prison from the inside. A few days ago the two administrative criminal proceedings were stopped.
But how did it come about? “The crime scene is located in a 90 -minute short park zone east of the inn, which was canceled with the knowledge of the Constitutional Court of 13 June 2023 in the then valid version and therefore no longer applies,” says the two messages about the institutions of the procedures.
Does the city have to pay back money now?
The regulation of the city council of the city of Innsbruck of 16 July 2015 was eliminated as illegal by the Constitutional Court at the request of the State of the State of Tyrol. Means: “From 2015 to 2023, thousands of people can be illegally punished for eight years,” Hepperger emphasizes.
Müllerstraße and Anichstraße are not only, in which the two customers gathered the parking spaces, but also countless streets in the Saggen district of Innsbruck and in the city center. “This means that there are also numerous claims for the recovery of incorrectly punished parkers in the Chamber,” the lawyer believes.
