The German protection of the Constitution (BFV) agrees that the AfD no longer describes the AfD as “secure right -wing extremist”. The reason: the correct -wing party has brought a lawsuit against the classification.
The constitutional lawyers want to remain silent for procedural reasons – have decided on the urgent application of the AfD. This is how the procedure should be accelerated and the deadline is called.
It is not the first time that the protection of the Constitution has made such a promise. He had done this in January 2021 after the AfD at that time had sued the classification as a “suspected case”. At that time, the complaint was not successful for the party in two cases. The judgment of the higher administrative court in Münster is not yet final.
What does that mean?
This does not change the knowledge of protecting the constitution that the party is “secured Right -Wing Extremist”. However, the recovery obligation that is now given by the BFV means that the officials cannot observe the AfD to a judgment. However, observation as a presumably case can continue.
The AfDerschap sees a “partial success” in the step. Alice Weidel and Tino Chrupalla announced on Thursday afternoon: “This is a first important step in the direction of our actual relief and therefore to combat the accusation of the right extremism.”
Without the promise, the court could also have ordered that the protection of the constitution would have the classification of the assessment. The BFV published its new classification last Friday. The opinion of experts based on the decision was not published.
