Four and a half years in prison – 59-year-olds who required care by punching

In February, a 25-year-old beat a man in Vienna’s Landstrasse for nursing for no apparent reason. After a dispute broke out between the two, the 25-year-old punched his opponent in the face. The 59-year-old fell to the ground and suffered a skull fracture as a result of the impact, resulting in a cerebral hemorrhage and traumatic brain injury. The perpetrator was convicted Monday of assault with serious lasting consequences.

A panel of judges from the Vienna Regional Court has sentenced the three-time convict to an unconditional four-and-a-half-year prison term. The victim received compensation of almost 19,000 euros. After consulting his lawyer, the man accepted the sentence. The public prosecutor also agreed, so the verdict is final.

“I was so tense”
The suspect was on his way to the supermarket with his mother and girlfriend when his companions were approached and annoyed by the 59-year-old. “I was so in love with my girlfriend then,” the 25-year-old told the court. The completely unknown, visibly intoxicated man’s insulting comments made him feel “such stress”.

As a student who witnessed the scene described as a witness, the 59-year-old fell backwards to the ground after the impact, hit the back of his head on the asphalt and lay unconscious. Later research showed that the victim had 2.3 permille in the blood at that time. The defendant assured that he did not have a “full hit”. He just pushed the man away with his fist. If I had hit him really hard, more would have happened.” “Even more?” the judge intervened, “he can’t come here anymore to testify.”

“Hugely increased need for care”
The 59-year-old had undergone emergency surgery as a result of the serious injuries at a hospital. He spent 13 days in intensive care and another two months in a normal ward before being transferred to a nursing home on May 17. “He is bedridden, incontinent, disoriented in time and place and has a vastly increased need for care,” says forensic pathologist Nikolaus Klapp about the victim’s current health condition. It is feared that the man is facing a “prolonged, serious illness”. In any case, permanent incapacity for work and reduced memory performance can be assumed.
