German court: – Asylum applications from Syrians must be processed again

The federal office for migration and refugees (BAMF) in Germany can no longer postpone decisions about Syrians asylum applications. The Karlsruhe administrative court has now decided. A person involved had charged.

The background of the slide is the fall of Syrian ruler Bashar al-Assad about half a year ago. The office and many others have argued with the initially unclear political situation. In the meantime, however, there is sufficient information about the asylum and deportation-relevant situation after the power change, the Karlsruhe administrative court said. For example, the new Syrian government, led by Islamist HTS militia, has been ‘stable in power’ since the beginning of December and controls the majority of the country.

Since March, a detailed land report of the BAMF and assessments of the EU -Aasy lagstency are also available on issues of refugee legislation. There are also relevant German judicial decisions. That is why the situation in the country of origin of Syrians is no longer uncertain and the BAMF cannot rely on the provisions of the Asylum Act to postpone the applications.

Decision can still be challenged
The decision of the court is not yet final because it can still be disputed.

At the beginning of December 2024, an alliance around HTS Militia was the old Syrian ruler Assad after a civil war, which lasted more than 13 years. Millions of Syrians had fled the country from the country during this period, many of them also to Austria. According to the federal statistical office, around 712,000 Syrian protection seekers were registered in Germany at the end of 2023. They were the largest group after people from Ukraine.
