The public prosecutor’s office in Wels (Upper Austria) is investigating two doctors and a midwife after the death of a boy. The clinic in Vöcklabruck has since responded to the parents’ complaint.
Luke’s fate shook “Krone” readers. Due to a completely unsuccessful delivery at the Vöcklabruck clinic, the boy was born with severe brain damage – as a result of a uterine rupture. The mother herself lost a lot of blood and barely survived. Son Lukas then came to the University Hospital of Salzburg, a week later the parents had the machines turned off. “Our Lukas is dead because the doctors made mistakes,” Sabrina and Stefan W. accused the clinic.
Accusation: Death by gross negligence
After a self-report by the hospital, the public prosecutor’s office in Wels has launched an investigation against two doctors and a midwife. Accusation: Death by gross negligence. “The process is still open. A further investigation was recently ordered by the security authority,” said the spokesperson. An expert commissioned by the judiciary had already provided his expertise: According to this, a “sum of health care violations led to the rupture of the uterus, which “was the cause of death of Luke”.
In addition to the criminal proceedings, there is also a civil procedure pending at the regional court in Wels: as is known, the parents have sued the clinic. Now, three months after the lawsuit was filed, the clinic’s lawyers replied: “The claim is dismissed. The dismissal of the lawsuit is requested,” the letter reads.
The treatment was carried out according to the rules of the art
In principle, all allegations are denied: Contrary to what mother Sabrina W. described, risk factors would have been discussed at the doctor’s consultation before birth. It is also denied that the medical history was changed afterwards. In general, the treatment was carried out “lege artis”, ie according to the rules of medical art. And it is even argued that even if the medication had not been administered and a previous emergency cesarean section, Luke’s death “would not have been prevented with a high degree of probability”.
By the way: the clinic does not want to comment on the case at the request of “Krone”.
