WASHINGTON, April 4 (EFE) – The governments of Arizona, Louisiana and Missouri on Monday filed a lawsuit against the government of US President Joe Biden over its decision to suspend the use of a health standard that has expedited 1.7 million migrants over the past two years. They were expelled.
The lawsuit is being heard in the Eastern District of Louisiana by Attorney General Jeff Landry and is accompanied by Arizona peers Mark Brnovich and Eric Schmidt of Missouri.
Prosecutors say the Arizona State Attorney’s Office said in a statement that “the repeal of Title 42 will lead to an unprecedented crisis on the southern border that will have a devastating effect not only on the border states but across the country.”
The Biden government announced last week that it would end its use of the rule known as Title 42 next May, which is part of the 1944 Public Health Act and temporarily authorizes the expulsion of aliens for health reasons.
The government of then-President Donald Trump (20017-2021) applied this rule in March 2020, at the beginning of the Covid-19 pandemic, and Biden continued to use it despite the pandemic subsiding.
However, the US Centers for Disease Control and Prevention (CDC) explained last Friday that given the evolution of pandemic and vaccination coverage in the country, migrants no longer pose a health risk, so they will drop the headline next May42.
“While it is difficult to identify President Biden’s most irresponsible actions since taking office, the termination of Title 42 is undoubtedly one of the worst,” Brnovich said.
For his part, Missouri Attorney General Schmidt noted that “Title 42 is a crucial tool to control the flow of illegal immigrants across our southern border.”
Among the accused are President Biden; Health Secretary Xavier Bekera; National Security Secretary Alejandro Morocca and Border Patrol Chief Raul Ortiz.
A U.S. government official said last week that the entire administration was coordinating to “prepare for the potential increase in border crossings following the termination of the 42nd title.”
The source stressed that as of May 23, those who enter the United States illegally will be “expelled” under the pre-pandemic immigration regulations under Title 8.
“Those who cross the border without legal permission will be deported and if they can not prove their legal presence in the United States, they will return,” he warned.
The main difference between the regulations is that Title 8 obliges the authorities to transfer undocumented immigrants to detention centers within a few hours where they can apply for asylum, while Title 42 provides a deportation decision within 15 minutes and without a place of asylum.
