In the fraud process due to the bankruptcy of billion dollars from the former financial service provider Wirecard, there could be an opinion this year. To support this project, the public prosecutor now wants to remove some costs.
The restriction proposed by the court to particularly serious allegations is justified, said public prosecutor Matthias Bühring on Wednesday before the court of Munich. Judge of Judge Markus Hijdisch agreed that the remaining allegations against the three defendants can already be sufficient for high penalties. In the opinion of test participants, this makes a long-term prison sentence for the ex-Wirecard boss, the Austrian Markus Braun, more likely. Braun has been in custody for four and a half years.
The important points for the judgment, for which the evidence will now be limited, still include a number of allegations. In addition to the Bendefraude, this falsification of the financial statements of companies for the years 2016, 2017 and 2018, incorrect information about the capital market and unfaithfulness. In the original indictment alone, the allegations against the former Braun Brown CEO contain 43 different points.
Defense complains about “prejudices” by ex-managing director
The court had already shown that Braun could threaten ten to 15 years, according to the earlier evidence. Accordingly, Braun’s defender Theres Krausslach protested on Wednesday. She spoke about a “prejudice” of her client in a “disastrous procedure” in which court and public prosecutor are not interested in an investigation. Braun must be acquitted.
The Dax Group collapsed in June 2020, when he was on the road that 1.9 billion euros was missing trust accounts in Asia. According to the public prosecutor, Braun and the two would have invented billions of cases. The indictment is for counterfeit, fraud, market manipulation and unfaithfulness.
