The UN Human Rights Committee has ruled that the Spanish state has “violated the political rights of former members of the government and parliament of Catalonia” by suspending persecuted pro-independence politicians from their public positions before being sentenced in 2019.
The opinion of this UN advisory body, whose decisions are not binding, confirms a complaint lodged in 2018 by former Vice-President Oriol Junqueras and former ministers Raül Romeva, Josep Rull and Jordi Turull, alleging that the suspension of their positions without prior conviction violated the International Covenant on Civil and Political Rights.
The committee’s opinions, a mechanism that defines itself as “quasi-legal”, presuppose recommendations that are not binding in principle, but are believed to be considered by signatories to the International Covenant on Civil and Political Rights .
