The National Court archives the PP’s ‘box B’ case

The head of the Central Investigation Court Five has agreed to submit the case due to the outcome of the proceedings conducted, as the commission of the crimes that gave rise to its creation was not properly justified.

National Court Judge Santiago Pedraz agrees Provisional dismissal of the piece from the ‘Bárcenas papers’ of the Gürtel case, which investigated the alleged donations made by businessmen to the PP in exchange for public works awards, since the commission of the crimes that gave rise to this case was not properly justified.

In an order, the head of the Central Investigation Court Five agrees to the file at the request of the anti-corruption officer due to the outcome of the proceedings conducted during the investigation.

That was stated in that document “finds no violations of applicable regulations in the assessment of tender dossiers” and “makes it impossible to establish a relationship between payments or donations and the contracts awarded.”

The judge recalls that this part of the separate piece known as the ‘Bárcenas papers’ has been reopened February 28, 2017 on the occasion of the statements of the businessman Alfonso García Pozuelo and of the leader of the Gürtel plot Francisco Correa in the trial of the most important piece of the Gürtel case.

The IGAE report does not acknowledge the commission of the crimes

In his order, Pedraz points out that from the report of the General Intervention of the State Administration (IGAE) the commission of the crimes under investigation is not clear. “It analyzes the form of contracting, the possible incidents in the various files, but none of them concludes arbitrariness or irregularity,” he says.

He added that “They do not throw any element that makes the connection possible of said contracts with the alleged donations of the so-called ‘Bárcenas papers'”.
