The BOE publishes Organic Law 14/2022, which removes the crime of sedition from the Penal Code

The Official Government Gazette (BOE) posted this Friday Organic Law 14/2022of December 22, finally approved yesterday by the Senate, which removes from the Penal Code the sedition crime and that of eclipse, a rule that takes effect 20 days after publication in the legal journal, that is, January 12.

The approved standard is derived from the bill promoted by the PSOE and Unidas Podemos, which has been dealt with in Congress and the Senate in just six weeks and had as its main purpose the crime of sedition for which the independence leaders of the ‘process’ were convicted ‘, to replace it with a new type called aggravated public disorder, although other measures were also added, such as the aggravation of the punishment for concealing the body.

When it came time to introduce amendments to the articles in Congress, the PSOE and Unidas Podemos introduced other things, such as a new crime of illicit enrichment, at the same time as they agreed with ERC on an amendment to the penalties for embezzlement: when there is a profit motive, with current penalties retained (2 to 12 prison sentences and 6 to 20 disqualification); and two new types: a non-profit organization for “private use” (from 6 months to 3 years in prison and disqualification from 1 to 4 years) and another for when the person being embezzled serves a purpose other than that intended (from 1 to 4 years) . years imprisonment and 2 to 6 years disqualification).

The plenary session of the Senate finally approved the bill this Thursday, but without the amendments aimed at reforming the system of election and arrival of the two candidates for the Constitutional Court, to be appointed by the General Council for the Judiciary (CGPJ), because the court of guarantees suspended them.

The reform of the Penal Code continued in the Senate with a majority consisting of PSOE, ERC, Bildu, PNV and Més per Mallorca. It was rejected by PP, Vox, Ciudadanos, UPN, Junts, PRC, Coalición Canaria, Teruel Existe, PAR and the two independent MPs. For their part, Más Madrid, Geroa Bai and Compromís chose to abstain.
