The TSJPV has suspended the usansolo withdrawal de Galdakao as requested by the state attorney following the decision passed at the general assemblies of Bizkaia approving the segregation as reported by the Supreme Court.
The State Attorney had taken refuge on December 30 before the Controversial Chamber of the Supreme Court of the Basque Country (TSJPV) the agreement of the General Assemblies of Bizkaia approving the segregation of Usansolo de Galdakao and its creation as a new independent municipality.
In addition, he asked the suspension of a warrant of that agreement, passed on November 23, 2022, something the TSJPV rejected in an order made public this Monday, which is subject to appeal.
On appeal, the Public Prosecution Service considers that the detachment is in violation of the requirement that the new municipalities have a minimum population of 5,000 inhabitants, as laid down in Article 13.2 of the Local Regime Basic Law. In addition, it requested the TSJPV to annul the article of the Provincial Ordinance 9/2012 of Bizkaia, which reduces that number to a municipality of 2,500 inhabitants.
