The trial magistrate has rejected all the parties’ appeals following the penal reform that eliminates the crime of sedition and amends that of embezzlement.

Supreme Court magistrate Pablo Llarena has confirmed the prosecution of Carles Puigdemont, as well as former councilors Toni Comín and Lluis Puig, for embezzlement and disobedience for organizing the referendum on October 1.
In his order, Llarena rejects all appeals filed by the parties against his order of January 12, on the one hand those of Carles Puigdemont and former ministers Antonio Comín, Lluis Puig and Clara Ponsatí, and on the other hand those of the lawyers of the state and the office of the prosecutor.
The investigating judge of the trial has confirmed that the consequences of the penal reform, which eliminates the crime of sedition and modifies that of embezzlement, is that the prosecution of Puigdemont, Comín and Puig for the crime of embezzlement continues, while the said facts For the revoked crime of sedition now fits only crime of disobedience. In this sense, the judge refuses to apply the new crime of aggravated public disorder to those charged with sedition.
On the other hand, Llarena maintains the arrest warrant for Puigdemont, Comín and Puig in the Spanish state, contrary to what was alleged by the defense of Puigdemont and Comín. In addition, it explains that, in the event that defendants were materially deprived of liberty in Spain in the future, if it were deemed justifiable and effective to keep their imprisonment longer than the precise time to receive their statement, the authorization to various attend parliamentary meetings, provided their immunity had not been waived.
