Alfredo de Miguel and Aitor Telleria ask for a partial pardon not to go to jail

The former number two of the Alava PNV, Alfredo de Miguel, sentenced to 12 years in prison for corruption in the so-called “De Miguel case”, has asked not to go to prison through a partial pardon, a measure of pardon this was also requested by another of the 14 convicts, the former leader of the PNV from Alava, Aitor Telleria.

EITB Media has confirmed the presentation before the Provincial Court of Álava de several writings to prevent the internment of De Miguel and Telleria within ten working days in a penitentiary centre.

The Alava court must now hear the requests for extraordinary suspension of sentences, but not the pardon. The trial is expected to last no longer than the end of March, when the four people responsible for the plot should go to prison. Requests for suspension of pardons will be sent to the Department of Justice and their consideration will not prevent those requesting them from entering prison.

Alfredo de Miguel has demanded that the Court suspend all his sentences of less than two years and has sought only a partial pardon for the crime of unauthorized association, for which he was sentenced to 3 years.

As his defense has argued, Alfredo de Miguel is going to ask for reparations for some acts committed 17 years ago.

For his part, Aitor Tellería has asked for a pardon for the entire sentence and an extraordinary suspension of it due to illness.

Alfredo de Miguel faces up to 9 years in prison for the crimes of influence, deceit, bribery, false commercial documents, embezzlement and money laundering exceeding two years in prison.

Aitor Telleria was sentenced to six years and one month in prison for the crimes of subterfuge, embezzlement of public funds, false trade documents, influence peddling, money laundering and unauthorized association.

This Wednesday ends the three-day period granted by the Court of Álava to file an appeal, something that does not paralyze access to the prison provided for 4 of the 14 convicts in this case.

They are the aforementioned Alfredo de Miguel and Aitor Telleria, plus their fellow party member Koldo Otxandiano, sentenced to 7 years and 6 months in prison, and the former Youth Director of the Basque Government Javier Sánchez Robles, whose sentence is up to 7 years and one month in prison .

It is possible that Otxandiano will also request a suspension of the sentence due to illness, as he was on leave until the Basque government ordered his resignation at the Álava Technology Park after the sentence was handed down last Thursday.
