The European Court of Human Rights (ECtHR) on Monday rejected Spain’s appeal, through its public prosecutor, against the Strasbourg ruling condemning the Spanish state for violating the law. right to a fair trial of the ETA prisoner Xabier Atristain Since the request is not complied with, the verdict is fixed.

A panel of five ECHR judges was expected to decide this morning whether or not seven judgments would be referred to the Grand Chamber of the European Court, including Atristain’s, which had been appealed by Spain on April 13, as notified by the Ministry of Justice to the Supreme Court.

The ECtHR decision upheld Atristain’s appeal and condemned Spain to compensate him with an amount of 12,000 euros for non-material damage suffered and 8,000 for costs and expenses.

Atristain went to Strasbourg to denounce it while incommunicado in protective custody, he was denied access to a lawyer of his choice and was questioned by the police without the presence of a lawyer, leading him to make self-incriminating statements, which he said led to a 17-year prison term.

the association Etxerat believes that “there are hundreds of Basque prisoners, relatives of ours, who have charged themselves under incommunicado detention and torture, without their trusted lawyers during their detention”.

“The Spanish Supreme Court must apply the new European jurisprudence. Freedom for all,” he claimed on the social network Twitter after taking note of the ECtHR’s ruling.
