Sare has requested the annulment of all sentences of ETA prisoners who had no right of defense during their incommunicado detention, in application of the doctrine of the European Court of Human Rights (ECtHR) in the Atristain case.
In a final resolution, the ECtHR has ruled that it will not review the sentence that led to the release of Xabier Atristain, as requested by the country’s attorney.
The court ruled that Spain violated Atristain’s rights by not allowing him to choose a lawyer when he was held incommunicado in 2010, leading to his release after being sentenced in 2013 by the National Court to 17 years in prison for membership of a armed gang and possession of weapons and ammunition.
In a press appearance in Vitoria-Gasteiz, spokespersons for Sare, Joseba Azkarraga and Bego Atxa pointed out that the ECtHR’s decision affects “a very significant number” of detainees, although they did not specify a specific number or indicate those who requested review their verdict.
They believe that it is the National Court and the Supreme Court that “should provide a legal solution to all these cases” without forcing those affected to go to the ECtHR “to assert their rights”.
“It is time to end this situation and we will continue to condemn actions that, such as deprivation of the right of defense, question the existence of a democratic state,” they said.
