Agreement with Austria – Romania wants to take back asylum seekers more quickly

Romania has committed to Austria to expedite the readmission of asylum seekers who, in accordance with the Dublin Regulation, must return to the country where they first entered EU territory. Romanian law stipulates, among other things, that the processing of transfer applications is simplified and shortened.

The government in Bucharest said the agreement contains “practical methods for a more efficient implementation of the Dublin Regulation” by Austria and Romania. This arrangement benefits internal EU states such as Austria, while it has the opposite effect for member states located on the EU’s external border. The more closely these states control their borders, the greater the number of asylum seekers for which they are solely responsible – due to the lack of a European system for the distribution of asylum seekers.

Apparently the government in Bucharest hopes to relax Austria’s blocking position on Romania’s accession to Schengen. The government in Vienna claims that the vast majority of asylum seekers apprehended in this country are not registered, even though they have crossed several EU countries en route. The Dublin system does not apply to these people. It only applies to asylum seekers who have been registered by an EU state and later left it unlawfully.

The European Commission and Romania are increasing the pressure on Austria
Recently, both the European Commission and the Romanian government have increased pressure on Austria. In her State of the EU address, Commission President Ursula von der Leyen called on Romania and Bulgaria to join the Schengen area “without further delay”. Romanian Prime Minister Marcel Ciolacu wants to see his country in the Schengen area by December. If Austria blocks one of the next two meetings of EU interior and justice ministers, it will challenge the decision at the Court of Justice of the European Union (ECJ), Ciolacu said on Monday.
