On the sidelines of the ÖVP’s Commission of Inquiry, there was another blowout on Wednesday alongside the publicized investigations against National Council President Wolfgang Sobotka. Justice Minister Alma Zadic announced in the private part of her interrogation that the head of the public prosecutor’s office in Vienna, Johann Fuchs, has been suspended. The reason: There are charges against Fuchs.
It is not known exactly what he is accused of. The suspension has been notified to the Supreme Court as the competent disciplinary committee. Now he has to decide. “The reason for the measures was that, in view of the indictment, the suspension seemed necessary in view of the nature or seriousness of the indictment in the interest of the civil service or to protect the reputation,” the ministry motivated the move on Wednesday evening.
Even the spokesman for the Innsbruck prosecutor, Hansjörg Mayr, could not say why Fuchs was charged. Mayr stated that it was a private act. The Innsbruck prosecutor’s office launched an investigation against Fuchs last year on suspicion of breach of professional secrecy. There was an allegation that Fuchs would have forwarded information about the state of affairs – for example in the Gernot Blümel case – to the already suspended BMJ section head Christian. An investigation has also been conducted into a suspected false statement. Parts of the investigations were discontinued in the autumn.
Fuchs had come under pressure after news between him and Christian Pilnacek, who was also suspended, became public. The two talked about the observation of an employee of the Economic and Corruption Prosecutor’s Office (WKStA) as part of the service and technical supervision.
Fuchs has not been responsible for WKStA since last year
As a result of the allegations, the division of tasks of the Vienna Public Prosecutor’s Office had already changed in essential aspects last year. Since then, Fuchs is no longer responsible for matters related to the WKStA.
