The Constitutional Court (VfGH) has been investigating the legal basis for the benefits for months and is reversing parts of the Corona support legislation. There are 450 billion euros at stake due to the upcoming decision.

The “Standard” refers to internal documents of the Ministry of Finance, according to which 450 million euros in “COFAG subsidies” (the Federal COVID-19 Financing Agency GmbH) have been budgeted for 2024. According to the newspaper, the Ministry of Finance declined to comment indicate the amount.

According to the report, the VfGH is particularly critical of the fact that COFAG was not subject to the instructions of the Minister of Finance and that the lack of a legal right to financial support could conflict with “the right to property, the rule of law and the principle of equality”. The decision could come next week or the week after.

The ministry prepares for contingencies
Depending on the content, this may mean that COFAG can no longer pay out and the law must be repaired. The Ministry of Finance says the federal liquidation company handling COFAG will finalize a draft as soon as the VfGH ruling is available. “All cases that are still open will of course be dealt with,” they promise.
