The Supreme Court has corrected its original criteria and, by a narrow majority, three votes to two, will now review pardons to the Catalan independence leaders sentenced to prison for the trials, following a change in the magistrates who make up the Chamber.

Legal sources have reported that the Fifth Division of the Controversial Administrative Chamber of the Supreme Court has assessed by one vote the appeals for reconsideration brought by the plaintiffs against this same Chamber’s decision not to review the pardon.

The Fifth Section rejected last January – also by a meager three-to-two majority – all means, individuals and parties (PP, Vox and Ciudadanos) against the pardon of independence leaders in prison, estimating the lack of legitimacy alleged by the State Attorney.

Against that decision, the appellants filed an appeal for reconsideration, which is now in the hands of a chamber which has been changed by the retirement of the then President Segundo Menendez, replaced by the equally progressive Octavio Herrero, and above all by the departure of Ángeles Huet, replaced by the conservative Inés Huerta, who has upset the balance.

For example, the progressives Octavio Herrero and Ángel Arozamena voted against the means and the conservatives Ines Huerta, Fernando Román and Wenceslao Olea.

The court therefore ordered the continuation of the proceedings and postponed the ruling on the lack of legitimacy of the appellants, which had been brought forward by the Public Prosecution Service in all appeals against the conviction proceedings.

The Chamber has estimated all pleas, including those of the parties, except that submitted by the entity Pro Patrimonium Sijena and Jerusalem, which was unanimously rejected.
