“Freedom of fools” – pre-trial detention for Windl off the table: Mikl-Leitner irritated

The instructions from the Ministry of Justice to the Viennese public prosecutor’s office regarding the detention of German climate change bomber Anja Windl left the governor of Lower Austria, Johanna Mikl-Leitner, “extremely irritated”: “It gives the impression that climate-changers in this country enjoy freedom like fools. This is fatal,” the ÖVP politician emphasized in a statement on Tuesday.

“No matter how committed and consistent the police are in dealing with these chaotic people, if they are then attacked with kid gloves by the judiciary, it is of no use. “The signal that Justice Minister Alma Zadic (Greens, note) is sending to climate activists across Europe is unfortunately clear: there is freedom for these chaotic people on the streets of Austria,” Mikl-Leitner noted.

The regional court rejected the pre-trial detention
Once again there were calls for harsher punishments for climate activists. During protests on November 20 and 21, Windl cemented himself to the road with a mixture of quartz sand and superglue. She was subsequently arrested and transferred to Josefstadt prison.

The Vienna Regional Court has rejected a request for pre-trial detention submitted by the public prosecutor.

Pre-trial detention is therefore not an option for Windl
The Public Prosecution Service wanted to appeal against this decision. As a result, a project report was submitted to the Public Prosecution Service as the responsible authority. The Justice Department then issued instructions “to refrain from filing a complaint,” authority spokeswoman Nina Bussek said Monday.

The ministry emphasized that technical supervision of the prosecutor’s offices was exercised by Section V, which is responsible for individual criminal cases within the Ministry of Justice. In this specific case they have provided instructions on how to deal with this. The issue of pre-trial detention is therefore off the table for Windl.
