The PP initiative, approved by the Commission, has received the support of the far-right party Vox, Junts and PNV and the abstention of ERC, while PSOE, Sumar, Podemos and EH Bildu voted against.
Congress’s Housing and Urban Agenda Committee on Tuesday approved a non-legislative proposal from the PP urging the Spanish government to reform or repeal articles of the Housing Law “that violate the exclusive powers of the autonomous communities.”
They voted in favor of the initiative PP, Vox, PNV and Juntswhile PSOE, Sumar, Podemos and EH Bildu They voted against. And Esquerra Republicana (ERC), which was one of the main proponents of the standard during the last parliamentary term and who, however, supported the introduction of a bill in Parliament last summer appeal to unconstitutionalityhas chosen to abstain this time.
The PP proposal approved by Congress refers to Article 148 of the Constitutionwhich stipulates that the autonomous communities can take over powers in the field of urban planning and housing and therefore do not correspond with the state.
However, the document says that “the Housing Law repeatedly violates the exclusive powers of the autonomy” in these cases.
“All this leads to the conclusion that Law 12/2023 of May 24 It’s unconstitutionalalthough not only because of the violation of regional powers, but also, for example, because of the violation of the right to private property,” says the initiative approved by Congress.
However, at the same time as this non-legal proposal was approved, the committee rejected another PP initiative to abolish the Housing Act. rent regulation mechanisms.
PP and Vox voted in favor of this proposal, while PSOE, Sumar, ERC, EH Bildu, PNV, Junts and Podemos positioned themselves against it.
Of course, the PP managed to create a third initiative in the committee to meet the challenge access to housing for young people in Spain, thanks to the PNV abstention and the vote in favor of the Junts.
