The Lieutenant Prosecutor of the National Court Marta Durantez has been in favor amnesty to the twelve members of the Defense Committees of the Republic (CDR) processed by membership of a terrorist organization by not appreciating the violation of human rights in the acts of which they are accused.
During a hearing last Thursday, the representative of the Public Prosecution Service assured that this cannot be the case.based on assumptions and the potential damage that could have been caused“with his actions”but of certainties“And this is that there is no harm to the rights invoked as a result of exclusions in the amnesty law,” he added.
That is why he requested that the amnesty be applied.”as a reason for a preliminary ruling” -a pre-trial procedure- “and by virtue of what is laid down in the Criminal Code, criminal liability is declared extinguished and therefore the proceedings are freely dismissed.”
The public prosecutor has assured that “a serious and deliberate violation of human rights would have been necessary“which, in his opinion, “the defendants neither accomplish nor initiate.”
Durántez has stated that, “in defense of legality, the rights of citizens and the public interest protected by law, which must be carried out with full submission to the principles of legality and impartiality, carrying out a strictly technical interpretation of the standard and the factual assumption“, is the application of the amnesty.
The popular accusationfor his part was against the application of the amnesty, because “both terrorism and treason still exist in the law” and in his opinion had occurred.
