The judge of High CouncilPablo Llarena, has refused to grant amnesty for the crime of embezzlement that he attributes to the former president of the Generalitat, Carles Puigdemont, and the former ministers Toni Comín and Lluís Puig, and has agreed to keep the arrest warrants against them in force in the Spanish state.
Furthermore, the Court does not apply the amnesty law to the independence leaders who were sentenced to disqualification due to the trial of Oriol Junqueras, Raül Romeva, Jordi Turull and Dolors Bassa.
The House also agreed to refer a question of unconstitutionality to the Constitutional Court on the possibility of applying the amnesty law to the crime of disobedience.
Judge Ana Ferrer has signed a dissenting opinion as she excludes the crime of embezzlement from the amnesty and supports the submission of a preliminary ruling to the Court of Justice of the EU.
