He is pushing for the arrest warrant still in force against the former Catalan president to be lifted.
The Public Prosecutor’s Office has asked the investigating judge of the ‘trials’ in the Supreme Court, Pablo Llarena, to review his decision and apply the amnesty to the embezzlement attributed to former Catalan President Carles Puigdemont and the rest of the former councillors who are being prosecuted in absentia. “The will of the legislator is clear”, he defended, while stressing that “there is no other option than to apply the amnesty.”
In a letter, the prosecutors assure that Llarena’s decision not to consider the amnesty applicable to the embezzlement attributed to Puigdemont and the rest of the former councillors who are being prosecuted in absentia “is not in accordance with the law”.
“The Public Prosecutor’s Office does not agree with the interpretation supported by the order being appealed: we consider that the amnesty provided for in LO 1/2024 is applicable to the facts under investigation in this particular case,” they stress.
In line with this, they maintain that “it is not disputed that the facts under investigation constitute a crime of embezzlement.” However, he defends that the embezzlement attributed to Puigdemont did not lead to personal enrichment, nor did it harm the financial interests of the European Union.
Within the framework of the order, the Public Prosecutor’s Office is pushing for the national arrest warrant still in force against the former Catalan president and the rest of the suspects to be withdrawn.
