Constitutional Minister Karoline Edtstadler (ÖVP) takes Justice Minister Alma Zadic (Greens) to task following the Kreutner Commission’s report on an alleged two-tier legal system.
If such a report were on the table after almost five years of the legislature, one could ask the Minister of Justice “what she has done in recent years”. As for the withdrawn bill on the analysis of mobile phone data, she considers Zadic’s approach as “peculiar”.
The amendment to the law brought about by the Constitutional Court (VfGH) was adopted by the National Council’s Justice Committee, but did not reach the plenary session.
The main criticism was that the Public Prosecution Service was not involved in the processing of mobile phone data and that the task remained with the police. If this is in accordance with the Code of Criminal Procedure and the assessment of evidence seems to be better handled by the courts, then we can talk about it.
If the Minister of Justice believes that changes are needed, it is therefore up to her to submit a new bill. Time is of the essence in any case, because the Constitutional Court has announced that the provisions in question will expire at the end of this year.
No comment on two levels of justice
Edtstadler does not really want to assess the content of the report of the Martin Kreutner commission on a two-tier legal system, which she only ‘leafed through here and there’ because it does not fall within her area of responsibility. The task of the commission was to determine whether there was undue influence on the criminal proceedings. Here she is ‘too far away’ to comment.
The minister does not say with whom the ÖVP should form a coalition after the elections, only that in her view the People’s Party should be in the government: “Because it needs a broad centre and that is embodied by the ÖVP.” FPÖ should not be there – Boss Herbert Kickl and Climate Protection Minister Leonore Gewessler (Greens).
Edtstadler sees the end of the coalition between the ÖVP and the Greens visibly without sadness: “I actually believe that the best of both worlds has been achieved in this government constellation and that is why it is good that the voters have their say.”
