Penitentiary Supervision Judge Destroys Third Degree Of Two ETA Prisoners For Not Asking Forgiveness

The decision to revoke the third degree granted by the Basque government contradicts a recent resolution of the National Supreme Court which ruled that asking for forgiveness should not be considered a legal requirement for the award of a prison sentence.

The Central Court for Penitentiary Surveillance has withdrawn the third degreewhich presupposes a regime of semi-freedom granted by the Basque government to the prisoners of ETA Gorka Martínez Ahedo and Iñaki Bilbao Gaubeka on May 18, arguing that they did not expressly apologize to their victims.

According to several authorities, Prison Supervision Judge José Luis Castro admits in two separate orders that… Complaint appeals from the Public Prosecutor’s Office of the National Supreme Court against the progress of both inmates, so he agrees to reclassify the two as second class.

In resolving these pleas, Castro insists on the need to meet the requirement of express clemency for the victims to obtain prison terms, contrary to what was recently established by the First Criminal Division of the National Supreme Court, which is charged with resolve the means of appeal of the prisoners to the judgments of the Penitentiary Supervisory Court

According to a recent resolution of the said chamber, for which Judge José Ricardo de Prada was rapporteur, the wording is: that express forgiveness should not be considered a “legal requirement” to grant prison benefits.
