Álvaro García Ortiz is under investigation for leaking emails between Isabel Díaz Ayuso’s partner, Alberto González Amador, and the Public Prosecutor’s Office.
The Supreme Court has summoned the Attorney General, Alvaro Garcia Ortizto declare on January 29 that it has been investigated in the case in which he is being investigated for a crime of revealing secrets for the alleged leak of data of Alberto González Amador, the friend of the President of the Community of Madrid, Isabel Díaz Ayuso .
The head of the provincial public prosecutor’s office of Madrid, Pilar Rodriguezis also due to be investigated on January 30 for alleged disclosure of secrets.
The judge of the Supreme Court, Ángel Luis Hurtado, has agreed to subpoena both García Ortiz and Rodríguez as investigated, since the alleged participation of both in the criminal offenses that are the subject of this case must be supported after the procedure, and in particular in the reports drawn up by the Central Operational Unit (UCO) of the Guardia Civil.
The investigating judge of the case is of the opinion that “there is an indicative basis for assuming the relevant participation” of the attorney general “in that leak.” The magistrate argues that the proceedings conducted so far show that “he was the person who directed the steps leading to her, abusing the position of superiority he had over other prosecutors, who offered themselves at the disposal of him, and this can only be understood from his pre-eminent position as hierarchical superior of them all”.
As for prosecutor Pilar Rodríguez Fernández, the instructor indicates that “circumstances such as making himself available to Álvaro García Ortiz, being the person who provides Diego Villafañe Díez with the file of Alberto González Amador, which is ultimately leaked on March 12 in elDiario.esand agreeing to send the email of February 2, 2024 between the lawyer of Alberto González Amador and the prosecutor Julián Salto Torres to the Public Prosecutor’s Office, aware of the purpose it pursues, are also sufficient elements to justify his accusation.”
Furthermore, in the same order, the magistrate agrees to extend the status of investigation to the lieutenant prosecutor of the Technical Secretariat of the Public Prosecution Service, Diego Villafane Diezknowing that he, in consultation with the other two investigated, ‘could have agreed to reveal secrets or confidential information about another citizen, of which they would have been aware because of their job or position and which should not have been made public be made’. Villafañe has been summoned for February 5.
